These Terms of Service ("Terms") govern your use of the Hushh mobile application ("App") operated by Hushh ("we", "our", "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Medical Disclaimer

Hushh is a wellness and relief management tool. It is NOT a medical device and does NOT provide medical advice, diagnosis, or prescriptions.

The information, exercises, sounds, and programs provided in the App are for general wellness and informational purposes only. They are not intended to replace professional wellness evaluation or guidance from a qualified healthcare provider.

You should always consult your doctor, audiologist, or other qualified healthcare professional before beginning any new wellness program, especially if you experience severe or worsening vertigo, sudden hearing changes, or new onset of tinnitus.

If you are experiencing a medical emergency, call your local emergency number immediately.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

3. Account

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to update it as needed.

4. Subscriptions and Payments

• Free Tier: Basic features are available at no cost.
• Premium Subscription: Access to all features requires a paid subscription. Pricing is displayed in the App and on the App Store.
• Billing: Subscriptions are billed through your Apple ID account. Payment is charged at the time of purchase confirmation.
• Renewal: Subscriptions auto-renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
• Cancellation: You can cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions). You will retain access to Premium features until the end of the current billing period.
• Refunds: Refund requests are handled by Apple in accordance with their refund policies.
• Free Trial: If offered, a free trial converts to a paid subscription unless cancelled before the trial ends.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Distribute, share, or resell your subscription access
• Upload or transmit harmful, offensive, or infringing content
• Attempt to interfere with the App's infrastructure or other users' access

6. Intellectual Property

All content in the App, including sounds, graphics, text, software, and design, is owned by Hushh or its licensors and is protected by copyright and intellectual property laws. You may not copy, reproduce, or distribute any App content without our prior written consent.

7. User-Generated Content

Journal entries and personal data you create within the App remain your property. By using the App, you grant us a limited license to process this data solely to provide App features (such as generating PDF reports at your request).

8. AI Features Disclaimer

The "Ask Hushh" AI assistant provides general wellness information and is not a substitute for professional advice. AI-generated responses may not always be accurate or applicable to your specific situation. Always verify important information with a qualified professional.

9. Limitation of Liability

To the maximum extent permitted by law, Hushh and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Any wellness-related outcomes from using the App
• Loss of data or unauthorized access to your data
• Any interruption or cessation of the App's availability

10. Indemnification

You agree to indemnify and hold harmless Hushh from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

12. Termination

We may suspend or terminate your access to the App at our discretion if you violate these Terms. You may stop using the App and delete your account at any time.

13. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
